Terms of use of the website, services and shop

1. Who we are and scope

The powerise.it website, the online shop and the services described in these terms are provided by Umbrella 104 Srl, trading as Powerise, based in Montesilvano (PE), Italy, VAT no. IT02361310689, email info@powerise.it (hereinafter “Powerise”).

These terms govern: browsing the site; purchases in the shop (licensed software, renewals, hardware tools, services); technical services performed on our premises, at the customer’s or remotely (remapping, DPF/EGR/AdBlue/DTC software solutions, diagnostics, coding, training). Online services provided by related sites (TuningBot, OriginalECUfiles) are subject to the terms published on those sites.

By using the site or placing an order you accept these terms. If you do not accept them, do not use the site and do not order. The applicable terms are those in force at the time of the order; the current version is always published on this page.

2. Consumers and professionals

Powerise sells both to consumers (natural persons acting for purposes outside their trade or profession) and to professionals (workshops, auto electricians, tuners, file services, companies). Some clauses apply differently to the two cases and this is expressly stated. The mandatory provisions of the Italian Consumer Code (Legislative Decree 206/2005) apply to consumers in any event. Anyone ordering with a VAT number declares that they act as a professional.

3. Orders, prices and payments

An order placed through the shop is an offer to purchase; the contract is concluded with the order confirmation sent by Powerise by email. Powerise may refuse orders in the event of product unavailability, an obvious pricing error, non-payment or previous defaults.

Prices are in euro, VAT included where due, unless otherwise stated; shipping costs, if any, are shown before confirmation. Card payments are processed on Stripe servers: Powerise neither receives nor stores card data. Bank transfer and the other methods shown at checkout are also accepted. Digital products and licence activations are delivered after payment has cleared.

4. Software, licences and digital products

ECUDecoder, Ecu Soft Service (ESS), licence renewals and the other software sold are third-party products distributed by Powerise as an authorised reseller. Use is governed by the manufacturer’s licence, accepted on installation, which prevails over these terms as regards the software. In short:

The software functions (DPF, EGR, AdBlue, Lambda, IMMO, DTC removal and the like) may be used only where lawful: vehicles intended for off-road use, motorsport, export, testing, repair and diagnostics. The customer is solely responsible for how they are used.

5. Technical services on vehicles and files

For remaps, DPF/EGR/AdBlue/DTC software solutions, diagnostics, coding and remote jobs these rules apply:

• Preliminary diagnosis. Every job starts with an analysis of real faults and parameters; Powerise may refuse or suspend work on an engine or ECU in poor condition, informing the customer.
• Original file. Before any modification the original file is read, saved and delivered to the customer as a backup; restoring is always possible by writing the backup back.
• Remote work. The customer or workshop reading and writing the ECU with their own tool is responsible for correctly performing the read/write procedure and for the completeness of the data provided (make, model, engine, ECU type, software version). A file processed on incorrect or incomplete data does not entitle to a refund, but Powerise provides a correction where possible.
• Timing. Times given on the pages and in quotes are indicative; they are not of the essence unless agreed in writing.
• Manufacturer’s warranty. Modifying the calibration may lead the vehicle manufacturer to refuse warranty work on the engine and transmission. The customer is informed of this and assumes the risk.
• Road use. Removing or deactivating after-treatment systems (DPF, EGR, SCR/AdBlue) and removing limiters may make the vehicle non-compliant with type-approval and environmental regulations for use on public roads. These jobs are performed exclusively for vehicles intended for off-road use, motorsport, export, testing or repair: the customer declares this when ordering and is solely responsible for the subsequent use of the vehicle.

6. Delivery

Digital products, licences and files: delivered by email or by activation on the dongle within the time stated on the product page. Physical products (tools, dongles, hardware): shipped by courier, indicatively 2-5 working days in Italy, longer abroad; risk passes to the consumer on delivery. Any transport damage must be reported within 8 days of receipt, with photos of the packaging.

7. Right of withdrawal (consumers)

A consumer may withdraw within 14 days of receiving a physical product, without giving reasons, by writing to info@powerise.it; the product must be returned intact, in its original packaging, with return costs borne by the consumer. The refund is made within 14 days of receiving the return, by the same payment method.

The right of withdrawal does not apply, pursuant to art. 59 of the Italian Consumer Code:

• to digital content and software licences whose supply or activation has begun with the consumer’s express consent and acknowledgement that the right of withdrawal is lost (requested at checkout);
• to services already fully performed (processed files, completed jobs, activations and renewals already carried out);
• to customised products (licences tied to a dongle or serial number, custom configurations).

No right of withdrawal applies to professionals, unless agreed in writing.

8. Warranty and conformity

Consumers: physical goods and digital content are covered by the 24-month legal guarantee of conformity (articles 128 et seq. and 135-octies et seq. of the Italian Consumer Code); defects must be reported to Powerise, which repairs, replaces or refunds within the statutory terms. Professionals: the manufacturer’s warranty applies to hardware (normally 12 months) together with the warranty for defects under articles 1490 et seq. of the Italian Civil Code, with notice within 8 days of discovery.

The warranty does not cover: damage from improper use, tampering, incorrectly performed read/write procedures, power interruptions during writing, hardware modifications to the vehicle, files written to vehicles other than the one declared, loss of or damage to the dongle.

If a file solution does not work: restore the backup and contact us; we analyse the logs and provide the fix. Support is included in the service.

9. Customer account

Account credentials are personal: you are responsible for keeping them safe and for the activity carried out with your account. Report any unauthorised use to Powerise immediately. Powerise may suspend accounts used in breach of these terms, for fraud or for abuse of the services.

10. Intellectual property

Texts, images, logos, technical guides and the structure of the site belong to Umbrella 104 Srl or their respective owners and are protected by copyright and trademark law. You may consult and quote them for personal or informational use, citing the source; copying, republishing or commercial use without written permission is not allowed. The trademarks mentioned (ECUDecoder, Ecu Soft Service, Alientech, KESS3, KTAG, ECM Titanium, TuningBot and others) belong to their respective owners. Files processed by Powerise are licensed to the customer for the vehicle stated and may not be resold or distributed.

11. Proper use of the site

It is forbidden to: access the site or connected systems without authorisation; interfere with the operation of the site; use automated tools to extract content in bulk; send unlawful, offensive or spam content through the forms; use the services for illegal purposes. Powerise may restrict or block access in the event of a breach.

12. Limitation of liability

Powerise performs its services with the required professional diligence and provides the technical information on the site for information purposes: data on margins, consumption and results are indicative and depend on the individual vehicle. To the extent permitted by law, Powerise is not liable for indirect damage, loss of profit or downtime; towards professionals total liability is limited to the price paid for the product or service concerned. Nothing in these terms limits liability for wilful misconduct or gross negligence, nor the mandatory rights of consumers.

The site may contain links to third-party sites (manufacturers, TuningBot, OriginalECUfiles): Powerise is not responsible for their content or their terms.

13. Personal data

The processing of personal data is described in the Privacy and cookie policy, which forms an integral part of these terms.

14. Changes to these terms

Powerise may update these terms to reflect legal, technical or commercial changes. Changes apply to orders placed after publication; for ongoing relationships they will be communicated with reasonable notice where they have a material effect. The date of the last change is shown at the top of the page.

15. Governing law and jurisdiction

These terms are governed by Italian law. For disputes with consumers the courts of the consumer’s place of residence or domicile have jurisdiction; the consumer may also use the European Online Dispute Resolution (ODR) platform or an ADR body. For disputes with professionals the Court of Pescara (Italy) has exclusive jurisdiction.
